10.12 REHABILITATION
- An application for rehabilitation will not be read by the presiding judge,
if the master’s report is not in the court file. The presiding judge
will only accept the master’s report from the bar in exceptional circumstances
made out in an affidavit
- If the applicant avers that a contribution paid by a creditor has
been repaid to the creditor, adequate proof thereof must be provided.
- The applicant, as is required by section 127 of Act 24 of 1936, must
state what dividend was paid by the creditors. It is not acceptable to
attempt to comply with this requirement by attaching the distribution account
which
the presiding judge is expected to analyse and interpret.
- As the date of the hearing of an application for rehabilitation has been
advertised, any postponement of the application will be to a specific date.
